These Terms apply exclusively to purchases made through the Website.
Purchases made through third-party retailers, physical stores, or pop-up locations are subject to the terms and conditions of those respective sellers and are not governed by these Terms.
By placing an order through the Website, you confirm that you have read, understood, and agree to be bound by these Terms.
3. PRODUCTS
All products offered on the Website are produced in small batches and are handmade.
Due to the artisanal nature of the products, slight variations in color may occur. These variations are not considered defects but part of the uniqueness of each item.
Certain products may be made from delicate materials (such as silk) and require appropriate care. Cireretta shall not be held responsible for damage resulting from improper use or care.
4. PRICES AND PAYMENT
All prices are indicated in Euros (€) and include applicable taxes unless otherwise stated.

Payment is captured at the time of purchase, including for pre-orders.
Cireretta reserves the right to modify prices at any time; however, products will be invoiced based on the price applicable at the time of order confirmation.
5. ORDER PROCESS AND CONTRACT FORMATION
By placing an order, you are making a binding offer to purchase the selected products.
The contract is considered concluded when you receive an order confirmation email containing your order number.
Cireretta reserves the right to refuse or cancel any order in cases including, but not limited to:

Suspected fraud or unauthorized transactions

Payment issues

Errors in product or pricing information
6. SHIPPING AND DELIVERY
Orders are shipped worldwide using different courier services depending on the destination.
Delivery times are estimates and may vary.
The customer is responsible for providing accurate shipping information. Cireretta shall not be liable for delivery failures or additional costs resulting from incorrect or incomplete addresses provided by the customer.
Risk of loss or damage to the products transfers to the customer upon delivery.
7. RIGHT OF WITHDRAWAL (EU CONSUMERS)
In accordance with EU consumer law, you have the right to withdraw from your purchase within 14 days of receiving your order, without giving any reason.
To exercise this right, you must notify us within this period.
Conditions:

Items must be returned in their original condition, unworn, unused, and with all original packaging & tags.

Returns that do not meet these conditions will be rejected, and no refund will be issued.
Refunds:
Refunds (or store credit, if chosen) will be processed only after the returned product has been received and inspected at our facilities.
Costs:
Unless otherwise stated, return shipping costs are borne by the customer. If the item is defective or incorrect, Cireretta will cover the return shipping cost.
8. RETURNS AND EXCHANGES
We offer the option of:

Store credit
Returns that show signs of wear, damage, washing, or use will not be accepted. Neither, if the official tag is removed.
Exchanges:
As each design is produced in a single cut, exchanges can be made for a different item from the catalogue, subject to stock availability. If no suitable alternative is available, store credit will be offered.
To protect the integrity of our exchange policy: any item showing signs of use, wear, washing, or alteration will be automatically excluded from the right to exchange. Cireretta reserves the right to refuse an exchange if the returned item does not meet return conditions, without any obligation to accept the item or issue any compensation.
9. QUALITY CONTROL & DISPATCH DOCUMENTATION
Before every order is dispatched, Cireretta conducts a quality inspection and photographs each item. This documentation is retained as proof of condition at the time of shipment and may be used as reference in the event of any dispute regarding the condition of a received item.
10. LEGAL GUARANTEE (CONFORMITY)
All products purchased on the Cireretta website are covered by the legal guarantee under EU Directive 1999/44/EC and Spanish law for a period of 3 years from delivery.
This guarantee covers products that do not conform to the contract at the time of delivery, including:

Manufacturing defects (stitching, seams, missing elements)

Incorrect items shipped

Major material flaws (holes, tears present at delivery)
Exclusions: The following are not covered under the legal guarantee:

Normal wear and tear

Minor color, texture, or finish variations due to handmade production

Stains, discoloration, or damage caused by improper care or misuse

Damage resulting from ironing, washing, or accidental use
How to claim your legal guarantee:

Report the issue of delivery (ideally within 14 days for faster resolution) by emailing ciaobaby@cireretta.com with photos and a description.

Cireretta will evaluate your claim within 14 business days.

If the defect is confirmed:

We will offer repair if feasible

Offer a replacement if stock allows

Provide a refund if repair/replacement is not possible
Return shipping is covered by Cireretta only for defective or incorrect items.
At Cireretta, we stand by the quality of our handmade products. Due to the delicate nature of our fabrics, please follow the product care instructions carefully to ensure your pieces remain in perfect condition.
11. LIABILITY
To the extent permitted by law, Cireretta shall not be liable for:

Indirect or consequential damages

Damages resulting from improper use of the products

Normal wear and tear, especially in delicate materials such as silk
Nothing in these Terms limits consumer rights under applicable law.
12. INTELLECTUAL PROPERTY
All elements of the Website and the products offered, including but not limited to designs, garments, patterns, illustrations, photographs, images, videos, text, logos, trademarks, and overall brand identity, are the exclusive property of Cireretta or its licensors and are protected by applicable intellectual property laws.
The purchase of a product does not grant any intellectual property rights over the product or any associated content.
Any reproduction, distribution, modification, public communication, or use of such content or designs, in whole or in part, for commercial or non-commercial purposes, without prior written consent from Cireretta, is strictly prohibited.
In particular, the following are expressly prohibited:

The use of Cireretta’s images or content for commercial purposes (including resale platforms, marketplaces, or third-party websites) without authorization

The reproduction or imitation of product designs or distinctive elements of the brand

The use of Cireretta’s name, trademarks, or branding in a manner that may create confusion or imply affiliation
Cireretta reserves the right to take legal action in response to any infringement of its intellectual property rights.
13. FORCE MAJEURE
Cireretta shall not be held liable for delays or failure to perform obligations due to events beyond its reasonable control, including but not limited to natural disasters, strikes, supply chain disruptions, or transportation issues.
14. DATA PROTECTION
Personal data will be processed in accordance with our Privacy Policy.
15. APPLICABLE LAW AND JURISDICTION
These Terms are governed by Spanish law.
If you are a consumer residing in the European Union, you will benefit from any mandatory provisions of the law of your country of residence.
Any disputes shall be subject to the competent courts in accordance with applicable consumer protection laws.
16. MODIFICATIONS
Cireretta reserves the right to update or modify these Terms at any time. The applicable version will be the one in force at the time of purchase.
